4. Eligibility and Customer Responsibilities

Customers entering into binding purchase, rental, or service agreements must be at least 18 years old and legally capable of entering into contracts.

Customers acting on behalf of a business or organization represent that they have authority to enter into agreements on behalf of that entity.

Customers agree to provide accurate contact, billing, delivery, and event information.

Customers are responsible for ensuring that the products and services they order are suitable for their intended applications.

5. Quotations, Orders, and Acceptance

All quotations are subject to equipment availability and confirmation by LEDVOLUZION.

Unless otherwise stated in writing, quotations remain valid for 10 days.

Submitting an inquiry, requesting a quotation, or adding an item to an online cart does not guarantee availability or constitute acceptance of an order.

An order becomes binding when LEDVOLUZION accepts the order and the customer accepts the applicable purchase, rental, or service terms.

LEDVOLUZION may reject or cancel orders because of inventory limitations, inaccurate product information, payment verification issues, suspected fraud, or circumstances beyond its reasonable control.

If LEDVOLUZION cancels an accepted order that cannot be fulfilled, it will refund payments for the unprovided products or services, subject to applicable law.

6. Pricing and Payment Terms

All prices are displayed in United States Dollars (USD), unless otherwise specified.

Prices may exclude applicable sales taxes, delivery charges, installation costs, equipment handling fees, and other disclosed charges.

LEDVOLUZION may accept payments through authorized third-party payment processors.

Payment methods may include credit cards, debit cards, electronic payments, bank transfers, or other approved methods.

Payment requirements will be disclosed before the customer completes a transaction.

Depending on the transaction, LEDVOLUZION may require full payment or a deposit before confirming an order or reserving rental equipment.

Any remaining balance must be paid according to the applicable invoice or written agreement.

LEDVOLUZION does not currently offer recurring subscriptions under these Terms. Purchases and rentals are billed as one-time transactions unless a separate written agreement expressly provides otherwise.

Customers are responsible for applicable taxes and properly disclosed fees.

7. Equipment Rental Terms

This section applies to customers renting lighting equipment from LEDVOLUZION.

7.1 Ownership

All rented equipment remains the exclusive property of LEDVOLUZION or its designated equipment owner.

Rental agreements do not transfer ownership rights to the customer.

7.2 Rental Period

The rental period begins and ends at the dates and times specified in the customer's confirmed rental agreement.

Extensions must be approved by LEDVOLUZION.

Additional rental charges may apply to approved extensions or unauthorized late returns, as disclosed in the rental agreement.

7.3 Equipment Condition

Rental equipment will be provided in working condition, subject to reasonable wear and previously disclosed cosmetic imperfections.

Customers must inspect the equipment upon receipt and promptly notify LEDVOLUZION of missing components, visible damage, or operational problems.

7.4 Customer Care and Use

Customers agree to:

• Use equipment only for its intended purpose.

• Follow manufacturer instructions and safety guidelines.

• Protect equipment from excessive moisture, heat, impact, and other hazardous conditions.

• Use compatible power supplies, mounting systems, controllers, and accessories.

• Prevent unauthorized modification, repair, or disassembly.

• Avoid overloading electrical circuits or using damaged cables.

• Return all rented equipment and accessories according to the rental agreement.

Customers must not sublease or transfer rented equipment to third parties without written authorization.

7.5 Loss, Theft, and Damage

Customers may be financially responsible for loss, theft, damage beyond ordinary wear and tear, or missing components occurring while the equipment is in their custody or control, to the extent provided in the applicable rental agreement and permitted by law.

Charges will be based on reasonable repair costs, replacement costs, or other disclosed contractual amounts, as applicable.

LEDVOLUZION will not automatically treat normal wear and tear as customer-caused damage.

7.6 Late Returns

Equipment returned after the agreed rental period may be subject to additional rental charges.

The applicable late-return rate, grace period, and calculation method must be disclosed in the rental agreement.

7.7 Security Deposits

LEDVOLUZION may require a refundable security deposit for certain rental transactions.

Deposit amounts, permitted deductions, inspection procedures, and refund timing will be stated in the applicable rental agreement.

Security deposits are separate from rental payments unless expressly stated otherwise.

8. Equipment Sales

Products purchased from LEDVOLUZION are subject to the specifications, pricing, and conditions disclosed at the time of sale.

LEDVOLUZION endeavors to provide accurate product descriptions, images, and specifications.

However, product photographs may differ slightly from actual items because of manufacturer changes, display settings, or lighting conditions.

Customers should verify compatibility, dimensions, power requirements, and technical specifications before purchasing.

Ownership of purchased products transfers according to the applicable sales agreement and governing law.

Risk of loss during shipment or delivery will be determined by the agreed delivery terms and applicable law.

9. Shipping, Delivery, and Pickup

Shipping and delivery availability depend on the customer's location, equipment size, inventory, and selected services.

Estimated delivery dates are not guaranteed unless expressly agreed in writing.

Customers must provide accurate delivery information and ensure that the delivery location is reasonably accessible and safe.

Additional charges may apply for special handling, restricted access, expedited delivery, or unsuccessful delivery attempts when disclosed and agreed.

Responsibility for equipment during delivery, pickup, and transportation will be determined by the applicable transaction agreement and governing law.

10. Installation and Technical Services

LEDVOLUZION may provide professional installation, programming, configuration, and technical support.

Customers must provide reasonable access to the installation site and disclose relevant site conditions, electrical limitations, and safety hazards.

Where applicable, customers are responsible for obtaining necessary venue permissions, property-owner approvals, and event permits unless LEDVOLUZION expressly agrees to obtain them.

Electrical work requiring a licensed professional will be performed only by appropriately licensed personnel.

LEDVOLUZION may suspend or decline installation when site conditions present an unreasonable safety risk.

Any additional work beyond the agreed scope may require a revised quotation or written change order.

11. Safety and Proper Equipment Operation

LED lighting equipment must be installed and operated in accordance with manufacturer requirements and applicable safety regulations.

Customers must ensure that equipment is used with appropriate electrical infrastructure, mounting hardware, and environmental protections.

Only qualified individuals should perform activities requiring specialized electrical, rigging, or technical expertise.

Customers must not bypass safety devices, modify electrical components without authorization, or operate equipment in unsafe conditions.

LEDVOLUZION is not responsible for damage or injury caused by misuse, unauthorized modifications, or improper third-party installation to the extent permitted by law.

Nothing in these Terms eliminates responsibility that cannot legally be excluded.

12. Cancellations and Refunds

Cancellation and refund eligibility depends on whether the transaction involves an equipment purchase, rental reservation, or installation service.

12.1 Product Purchases

Returns and refunds are subject to LEDVOLUZION's published Return and Refund Policy and applicable consumer protection laws.

The policy should specify eligible products, return deadlines, product condition requirements, return shipping responsibilities, and refund processing procedures.

12.2 Equipment Rentals

Rental cancellation terms, including any cancellation deadlines and permitted charges, must be disclosed before booking confirmation.

Any nonrefundable reservation fees or deposits must be clearly identified before payment.

12.3 Installation Services

23. Indemnification

This obligation does not apply to the extent a claim results from LEDVOLUZION's own negligence, misconduct, or breach of its legal obligations.

24. Events Beyond Reasonable Control

Neither party will be responsible for delays or failures to perform nonpayment obligations caused by circumstances beyond its reasonable control, including natural disasters, severe weather, governmental restrictions, transportation disruptions, utility failures, or other extraordinary events.

The affected party must provide reasonable notice when practicable and take reasonable steps to minimize disruption.

Where services cannot be performed, refunds, rescheduling, and other remedies will be handled under the applicable agreement and governing law.

25. Suspension or Termination

LEDVOLUZION may suspend Website access or terminate a transaction when a customer materially violates these Terms, engages in fraudulent conduct, or creates a substantial safety or security risk.

Where reasonable, LEDVOLUZION will provide notice and an opportunity to resolve the issue.

Termination does not eliminate payment obligations lawfully accrued before termination or statutory rights that survive termination.

26. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict-of-law principles, except where mandatory laws of another jurisdiction apply.

The parties agree to attempt to resolve disputes informally through good-faith communication before commencing legal proceedings, except where immediate legal relief is necessary.

Subject to applicable law and mandatory jurisdictional requirements, disputes may be brought before courts of competent jurisdiction in Clark County Nevada.

Nothing in this provision deprives consumers of rights or remedies that cannot legally be waived.

No mandatory arbitration requirement is imposed by these Terms.

27. Changes to These Terms

LEDVOLUZION may update these Terms to reflect changes in business operations, products, services, legal requirements, or Website functionality.

Updated Terms will be published on the Website with a revised effective date.

Material changes will be communicated when required by law.

Changes will not retroactively alter existing binding transactions without a lawful basis or the parties' agreement.

Continued Website use after updated Terms become effective may constitute acceptance where permitted by law. For changes requiring affirmative consent, LEDVOLUZION will obtain that consent.

28. Severability

If a separately signed agreement expressly conflicts with these general Terms, the separately signed agreement will control for that transaction unless otherwise stated.
